These terms govern your use of owlextech.com (the “Site”) and the OWLEX handheld remote app for Android and iOS, package id com.owlextech.owlex (the “App”). By using the Site or installing the App, you agree to these terms. If you do not agree, do not use them.
The public copy is https://owlextech.com/terms. How we handle information is described in the Privacy Policy, not in this page.
1. What the services are
The Site is the official OWLEX website: product information, community pages, support, and media. Some areas (including community discussion) may be invite-only or unfinished.
The App is a handheld remote for an OWLEX optical accessory you already own. It connects over that accessory’s wireless network. It is not an online store, not a social network, and not a marketplace for firearms or wildlife products.
2. Who may use them
You must be old enough to form a binding contract in your country, and in any case at least 13. If you use the services for a company, you confirm you have authority to bind that company.
3. Lawful use
You must follow the hunting, firearms, export-control, wildlife, privacy, and general laws that apply where you are. You are responsible for whether a given use of the accessory and the App is legal in that place. We are not responsible for use that breaks those laws.
You must not:
- probe, overload, or disrupt the Site or the App
- scrape the Site in a way that impairs other visitors
- reverse-engineer the App except where a mandatory law gives you that right
- bypass an access limit (for example an invite-only community)
- upload malware, or content you do not have the right to use
- present yourself as Owlex, or as authorised to speak for us, without written permission
4. The website
Information on the Site (specifications, availability, imagery, field notes) is for general description. It is not a binding offer unless we say so in a separate purchase contract.
Community posts, waitlist forms, and similar features may be limited or switched off. If you submit text or media, you grant Owlex a non-exclusive licence to host and display it in that feature. You remain responsible for that content.
Outbound links (including Facebook, Instagram, and YouTube) are operated by those companies. Their terms and privacy rules apply once you leave our Site.
5. Using the App
You understand and accept that:
- Joining the accessory hotspot may drop the phone’s internet and calls until you leave that network. That is how the phone’s system behaves.
- The live image and the files on the accessory come from the hardware. We do not moderate them.
- Save to phone writes only the item you chose into an album named OWLEX. It does not copy your existing camera roll the other way.
- Format permanently erases photos and videos on the accessory, not on the phone. The App asks you to confirm before it runs.
- Installing a firmware file you chose can leave the accessory unable to start if the file is wrong or power is cut. The App asks you to confirm before the file is written.
- A particular phone, system version, or folding-phone pose may not work without interruption. We do not promise compatibility with every device.
Use the App only with genuine OWLEX accessories, or accessories we have said are compatible.
6. Intellectual property
The OWLEX name, marks, product names, Site design, and App are ours or our licensors’. You receive a personal, non-transferable licence to use the App on devices you own or control, and to browse the Site, solely to operate your accessory and to learn about OWLEX products.
You do not receive any other licence. Open-source components in the App are listed in Me → Open source licences and are governed by those licences.
7. No warranty
The Site and the App are provided as is and as available. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not promise that the live image will be continuous, that a shot will not be missed, that a firmware write you confirmed will succeed, or that the Site will be uninterrupted or error-free.
8. Limitation of liability
To the extent the law allows, Owlex and its directors, employees, and suppliers are not liable for:
- lost photos, videos, or other files
- an accessory that will not start after a firmware write or format you confirmed
- a missed shot or other field outcome because the live image paused, the hotspot dropped, or the phone lost cellular service
- indirect, incidental, special, consequential, or punitive damages
- loss of profit, data, or goodwill
If a court finds we are liable despite the above, our total liability for all claims arising out of the Site or the App is limited to the amount you paid us for the App in the 12 months before the claim (which is typically zero, because the App is not sold separately) or, if that measure cannot apply, the minimum amount the law requires.
Nothing in these terms limits liability that cannot be limited — including death or personal injury caused by negligence, or fraud — where your local consumer law forbids that limit.
9. Changes and availability
We may update the Site, the App, and these terms. The date at the top will change. If you continue to use the services after a change, you accept the new terms.
We may suspend or stop a feature (including a waitlist or community beta) without notice. We are not obliged to keep a particular firmware, language, or phone model working forever.
